Beach Club Punt West – Ecopunt 1, 3253 ML Ouddorp
Article 1 - Definitions
Beach Club Punt West: the company that offers catering services, rentals and facilities.
Customer: any natural person or legal entity that enters into an agreement with Beach Club Punt West.
Agreement: any agreement between Beach Club Punt West and the customer regarding the delivery of services or products.
Services: all catering services, events, rental of halls, boats, SUPs, bicycles, scooters and other facilities offered by Beach Club Punt West.
Rental: the temporary provision of vehicles, vessels or materials for payment.
Article 2 - Applicability
These general terms and conditions apply to all offers, agreements and deliveries of Beach Club Punt West.
Deviations are only valid if agreed in writing.
Article 3 – Reservations and payments
Reservations are only final after written or digital confirmation by Beach Club Punt West.
For group bookings, events or rentals, a deposit may be required.
The remaining amount must be paid at the start of the service or rental.
In case of late payment, Beach Club Punt West reserves the right to cancel the reservation without refund of amounts already paid.
Article 4 – Cancellation by the customer
In case of cancellation up to 7 days before the reserved date, the customer will not be charged any costs, unless otherwise agreed.
In case of cancellation between 7 and 2 days before the date, Beach Club Punt West may charge up to 50% of the reservation value.
In case of cancellation within 48 hours before the reserved date or in case of no-show, 100% of the reservation value will be charged.
Different cancellation conditions may apply to packages and events.
Article 5 – Cancellation by Beach Club Punt West
Beach Club Punt West may cancel the agreement in the event of force majeure (such as extreme weather conditions, fire, government measures).
In that case, the amount already paid will be refunded, without any obligation to pay further damages.
Article 6 – Use of catering facilities
Customers must strictly follow the instructions of staff.
It is not permitted to consume your own food and drinks unless otherwise agreed in writing.
Beach Club Punt West reserves the right to refuse entry or remove anyone in case of misconduct or disturbance of public order.
Article 7 – Rental conditions (boats, SUPs, bicycles, scooters)
The use of rented materials is entirely at the customer's own risk.
The customer must show valid identification and may be asked to pay a deposit.
The customer must handle the rented property with care and in accordance with the instructions.
In the event of damage, loss or theft of the rented property, the customer is fully liable for the repair or replacement costs.
It is not permitted to lend or rent out the rented property to third parties.
Legal regulations regarding minimum age and any required driving or boating licenses apply to boats and scooters. The customer is responsible for complying with these requirements.
Fuel costs are the responsibility of the customer, unless otherwise agreed.
In case of late return, Beach Club Punt West may charge additional rental costs.
Article 8 - Liability
Beach Club Punt West is not liable for loss, theft, or damage to customer property.
Participation in activities, use of facilities and rented materials is entirely at your own risk.
Beach Club Punt West is solely liable for damages directly resulting from intent or gross negligence on the part of its staff, and is limited to the amount paid by its insurer.
Article 9 – Insurance
The customer is responsible for arranging appropriate insurance (e.g. travel, liability or accident insurance) to cover the use of rented materials.
Any damage to third parties caused by the customer with the rented property is entirely at the customer's expense and risk.
Article 10 - Force majeure
Force majeure means: circumstances that prevent the performance of the agreement and that are not attributable to Beach Club Punt West, such as natural disasters, strikes, storms, government measures or defects in materials through no fault of Beach Club Punt West.
In the event of force majeure, Beach Club Punt West has the right to terminate the agreement in whole or in part without being liable for damages.
Article 11 - Complaints
Complaints must be reported in writing within 7 days of the visit or rental.
Beach Club Punt West will handle complaints as quickly as possible.
Article 12 – Applicable law
All agreements and disputes are exclusively governed by Dutch law.
Disputes will be submitted to the competent court in Rotterdam, unless mandatory law prescribes otherwise.
